Motions & Immigration Appeals

Motions

  1. Motion to Reopen
A formal request to reopen an immigration case if the person was ordered removed by an immigration judge due to changed circumstances or new evidence that was unavailable during the original proceedings.
  2. Motion to Terminate
A formal request to dismiss an immigration case. This may be granted if the charges are flawed or inaccurate, or if circumstances have changed.
  3. Motion to Change Venue
A formal request to transfer an immigration case to a different court. Valid reasons include relocation or inability to travel to the initially assigned location.

Stay of Removal

A temporary suspension of a deportation order, allows an individual to remain in the U.S. while pursuing legal appeals or other forms of relief.

Bond Hearings & Release Assistance

A legal proceeding where an immigration judge determines whether a detained individual should be released while their case is pending. If granted, the judge sets a bond amount that must be paid for release.
Licensed attorneys can assist detainees in securing their release and navigating the legal process.

ICE Check-in & Compliance Assistance

Individuals with pending immigration cases or removal orders may be required to attend regular check-ins at an ICE office.

A licensed attorney can assist during check-ins to:

  • Ensure compliance with legal requirements.
  • Advise on rights and obligations.
  • Prevent unnecessary complications.

Deferred Inspections

If a CBP officer cannot immediately determine a traveler’s admissibility at a U.S. port of entry, the individual may be scheduled for a deferred inspection later.
This appointment allows them to submit additional documentation to resolve any immigration concerns.
